OK, this is weird...
So I tried to go out to a club tonight with a couple of friends. Obviously, I'm not 21 yet, so I had a coupla drinks at home first - nothing major, like 2 shots or so.

So I walk into the place, get IDed and stamped and all that, and just as I'm going to pay some slut monkey stops me and asks how much I've had to drink. I just assume he smells it on me, so I'm honest and say "A little, maybe a couple of shots. Why?". And the guy says "Sorry, I can't let you in here - you're underage and have been drinking, and this is a public place."

I just say whatever, never heard of that one before but OK, and we leave, but that sorta pissed me off. What sort of stupid ****er does that ****, and what sorta stupid ****er would even enforce that, assuming it WAS a law?

Yeah, I truly had maybe a shot and a half of Jack over ice. Oh, and a small glass of plum wine. This was over about 2.5 hours.

If they get inspected, and you're there, underage, and have alcohol on your breath, it's their liquor license that goes in the crapper.

That's the strange thing about the american and British situation IMHO, you guys go to the hard stuff immediately, while here young(er) kids just go for a couple of beers and that's it.
(Usually a beer to far, but hey, we all have to learn where our limits are )

Actually I don't think that's accurate. AFAIK, in Texas, the TABC actually has to see them serving me in order to bust them. I could be wrong, but then again two of my friends who are bartenders told me that and have never heard of that law (which he said it was, DD), so I dunno.

DD, as to underage drunks stirring the place up, a)I was obviously not drunk, the people I was with, who hadn't been drinking couldn't believe anyone noticed b)why would they care anyway?

It seems as though this sort of law would get thrown out as a violation of due process, but I guess the idiots running the courts are just that - idiots who pander to the commie mommies.

Well, the whole process of getting the age limit at 21 was sneaking around the consitution anyway. After the Vietnam War, many states decided they would lower the drinking age limit to 18, because if you can die for your country you should be able to drink a beer. So, what the federal government ended up doing was threatening to remove highway funding if they didn't raise the age limit. Of course, the state's citizens would still be paying the federal taxes that went into the federal funding for roads, and they would still have to maintain the roads, so not complying with the feds would mean having to pay for the same thing twice. So in a sense the feds used blackmail to usurp a power that they aren't constitutionally given.

Of course, that's not going to stop me from drinking anyway! Nor will it stop the vast majority of people my age from drinking, people will ignore this unjust law.

DD, then that would explain why one of my non drinking friends smelled nothing, and my other non-drinking friend could barely detect it if I blew on his face.

My guess is that this guy was basically just an alcohol Nazi (read: slut monkey whoremongering bastard) who has kids and ascribes to the commie mommy theory that drinking "underage" is bad.

I guess my mistake was not popping an altoid, but other than breath there was no way my actions would have given away the fact that I had a drink.

Right, and the really odd thing is that the Supreme Court upheld this (IIRC) 7-2, on the reasoning that if the government could determine that the drinking age had ANYTHING to do with highways, it was a permissable restriction, while ignoring the issue of basic fairness and liberty.

DD is right about the 5% thing, I was about to point that out as well.

Funny, you'd think additional alcohol sales would more than make up the 5%, but I guess it comes back to my commie mommy/fundie theory, at least in some states (well, commie mommies in the north, fundies in the south).

Unfortunately the Feds seem to be quite the fans of using this devious little tactic to usurp authority from the states. The Feds basically have gained the ability to boss around the states to do what they want on education because they can threaten to withold education funding while still taxing the state's citizens for educations, thus using blackmail to extend their power further.

We debated that case briefly in my Con Law class a coupla years ago. As I recall, most people thought it was a crock of ****, but few people had actual arguments against it. Typical undergrad morons.

Not that it's a good decision, of course.
