The Chiricahua were especially creative, even by Apache standards.

Removing the eyelids and staking out under the sun was common, barbecueing over fire, shooting in non-lethal areas with arrows (lots of arrows), flaying with dull knives, progressive amputation of fingertips and toe tips and so on, just whatever sort of creative impulse occurred at the moment.

When the Chiricahua still were able to hold their own fighting the US (some two decades), it was common for US troopers to tie leather thongs to the triggers of their carbines, so they could pull the trigger with their foot while holding the barrel to their forehead, just in case they got trapped or overrun. Being taken alive was not an option.

Doesn't the felony murder rule automatically apply here, that being regardless of intent if you kill someone while comitting a felony, it's murder? The killing took place while both drunk driving and kidnapping, so it should be an automatic murder due to that.
